The Cabinet Accountability Act

PREAMBLE: This legislation is being proposed in order to help regulate and create a peaceful transition between vacating and newly nominated cabinet leaders.

BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS HERE ASSEMBLED THAT:

§1: This act shall be cited as the “The Cabinet Accountability Act of 2019” formally.

  • §1.1: Outgoing member of the cabinet shall be defined as; The department head who is leaving their office.

  • §1.2: Incoming cabinet member shall be defined as; The newly nominated department head who is replacing the outgoing member of the cabinet.

§2: Members of the Governor’s Cabinet are required to stay within their nominated and confirmed position until a new cabinet member is nominated and confirmed by the State of Firestone Senate with the following exceptions presented below.

  • §2.1: The outgoing member of the cabinet must give a seven (7) day notice prior to vacating their office. After the seven (7) days the outgoing member must either transfer all department discords, trellos, documents, operation details, or any other means of data collected by the previous administration to the incoming cabinet member or the governor if the incoming cabinet member is not confirmed yet.

  • §2.2: The outgoing member of the cabinet may leave their position if the Governor of the State of Firestone orders or allows for them to leave before a replacement can be made.

  • §2.3: Once the new cabinet member is confirmed, the outgoing member shall vacate their office and transfer all department discords, trellos, documents, operation details, or any other means of data collected by the previous administration to the incoming cabinet member.

  • §2.4: In the event of impeachment in which the outgoing cabinet member was removed from office, they shall transfer all department discords, trellos, documents, operation details, or any other means of data collected by the previous administration to the Governor of the State of Firestone who shall give these documents to the incoming cabinet member once confirmed by the State of Firestone Senate.

  • §2.5: Should an outgoing cabinet member violate any of the statues set within this act they may be criminally charged with “Failure to properly discharge the duties of a cabinet member” within the court of law. Should an outgoing cabinet member be found guilty the courts may decide a suitable punishment; which may not exceed: twenty-four (24) hours of jail-time, suspension within Firestone departments in which they hold a job in, and POST certification suspension. The Firestone Congress shall hold the power to bar anyone who is in violation of this act from public office as well. The Department of Public Safety shall have the power to make a Public Safety Blacklist against the said outgoing cabinet member if needed.

§3: This act shall be enforced by the Governor of the State of Firestone and the State of Firestone Courts.

§4: This legislation shall go into effect upon passing both chambers of Congress and being signed by the Governor.
