Self Defense Extension Act

Preamble: To allow self-defense use for anything that should happen to a player so they can fight back for the safety of themselves and others. Also, allow for the forced removal of property they own should they be trying to do something bad.

BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS HERE ASSEMBLED THAT:

SECTION 1: Chapter 5, Section 7 of the Firestone Criminal Code currently states:

“ (a) Self defense shall be the act of employing force reasonable to the average person to stop or react to the harm of oneself when not in commission of a crime. Deadly force may only be employed in self defense to respond to a threat of serious bodily injury or death.

(b) Defense of another shall be the act of employing force reasonable to the average person to stop or react to the harm of another individual not in the commission of a crime. Deadly force may only be employed in defense of another to respond to a threat of serious bodily injury or death.

(c) Persons may use their legal (and or department provided) firearm, to act in self-defense or defense of another, or to use deadly force to prevent an escape of a fleeing suspect only if the individual has good-faith belief that the suspect poses a significant threat of death or serious physical injury. If a subject is fleeing from the scene or otherwise is no longer directly posing a threat, persons may still use lethal force on the pretense that the subject has the potential to, or reasonably may continue to pose such a threat to life as they were previously.

(AS PRESCRIBED BY THE UNIFORMED CONTROL OF FIREARMS ACT)"

SECTION 2: Chapter 5, Section 7 of the Firestone Criminal Code shall be amended to state:

“ (a) Self defense shall be the act of employing force reasonable to the average person to stop or react to the harm of oneself when not in commission of a crime. Deadly force may only be employed in self defense to respond to a threat of serious bodily injury or death.

(b) Defense of another shall be the act of employing force reasonable to the average person to stop or react to the harm of another individual not in the commission of a crime. Deadly force may only be employed in defense of another to respond to a threat of serious bodily injury or death.

(c) Persons may use their legal (and or department provided) firearm, to act in self-defense or defense of another, or to use deadly force to prevent an escape of a fleeing suspect only if the individual has good-faith belief that the suspect poses a significant threat of death or serious physical injury. If a subject is fleeing from the scene or otherwise is no longer directly posing a threat, persons may still use lethal force on the pretense that the subject has the potential to, or reasonably may continue to pose such a threat to life as they were previously.

(d) Persons may use non-lethal force to act in self-defense, defense of another, or to prevent the escape or potential escape of a suspect.

(e) Property owners and designees thereof may use non-lethal force to remove subjects who are unlawfully on or in their property and refuse to make reasonable efforts to vacate such after being commanded to do so by the property owner or a designee thereof - the authorized use of force in this situation may be expanded upon for specific properties or persons in accordance with already enacted and future legislation.

(f) Departmental employees may additionally use non-lethal force to prevent or deter malicious obstruction, interference, or other hazard to their lawful governmental duties after appropriate warning is given to such subjects to vacate and comply.”

SECTION 3: The newly amended Chapter 5, Section 7 of the Firestone Criminal Code named “§7 - Self Defence Doctrine” shall now become Chapter 4, Section 18 of the Firestone Criminal Code and renamed “§18 - Self Defence Doctrine”

SECTION 4: This shall go into effect immediately upon completion of the constitutional process required.

SECTION 5: Should any part of this Act be declared unconstitutional or otherwise struck down, the rest shall remain in effect unless all is struck down or declared unconstitutional.
