Open Carry Act of 2022

BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS HERE ASSEMBLED THAT:

Chapter I

SECTION I

(a) The Open Carry Act of 2022 shall be established.

SECTION II

(a) Chapter 5, Section 4 of the Firestone Criminal Code shall be amended.

(b) Chapter 5, Section 4 of the Firestone Criminal Code currently states,

“(a) The act of unlawfully brandishing a firearm shall be recognized as an unlawful criminal offense within the State of Firestone.

(a1) The act of unlawfully brandishing a firearm shall be the act of displaying one’s firearm, in an attempt to threaten or intimidate another person, or as a result of negligence in the proper or lawful handling of firearms- without proper justification to do so, as prescribed by this Code.

(b) Law enforcement personnel on duty shall be exempt from this Section.”

(c) Chapter 5, Section 4 of the Firestone Criminal Code shall be amended to state,

“(a) The act of unlawfully brandishing a firearm shall be recognized as an unlawful criminal offense within the State of Firestone.

(a1) The act of unlawfully brandishing a firearm shall be the act of displaying one’s firearm, in an attempt to threaten or intimidate another person, or as a result of negligence in the proper or lawful handling of firearms- without proper justification to do so, as prescribed by this Code.

(b) Law enforcement personnel on duty shall be exempt from this Section. Other exemptions shall be outlined by relevant law.”


Chapter II

SECTION I

(a) Any business officially licensed by the Firestone Department of Commerce may send a formal request in writing to the Chairman of the Firestone Firearms Commission (FFC), to request the ability for that business’s respective employees and/or contractors to ‘Open Carry’ their legally obtained firearms on that business’s respective property.

(b) The Chairman of the FFC shall forward such formal requests (as outlined in Chapter 2, Section 1, sub-section a of this act) to the rest of the FFC. Such written formal requests may be approved by the FFC with a ⅔ vote in affirmation.

(c) The FFC may retract the approval of any formal written request (as outlined in Chapter 2, Section 1, sub-section a of this act) with a ⅔ vote in affirmation.

(d) For purposes of this act, ‘Open Carry’ shall be defined as, “the act of openly showing a legally obtained firearm by utilizing the in-game mechanic of a legally obtained firearm facing toward the ground.”

(e) Open Carry shall only be permitted to be practiced by any business employee and/ or contractors on their respective business’s property, officially licensed by the Firestone Department of Commerce who has received written consent from the Firestone Firearms Commission to Open Carry.

(f) It shall be mandated that any business employee and/or contractors (officially licensed by the Firestone Department of Commerce who has received written consent by the Firestone Firearms Commission to Open Carry) shall be required to display their username via the Show Name in-game mechanic whilst practicing Open Carry.

(g) For purposes of this act, the ‘Show Name in-game mechanic’ refers to the literal game mechanic within Stapleton County that permits a user to display their full Roblox username above their character’s head to all physically adjacent users while the feature is enabled.

(h) Any business employee and/or contractor who has been officially licensed by the Firestone Department of Commerce and who has received written consent from the Firestone Firearms Commission to Open Carry shall be exempt from Section 5, Section 4 of the Firestone Criminal Code whilst practicing Open Carry.

i. Any business employee and/or contractor who practices Open Carry shall be required to possess a Civilian Firearm License (CFL).

SECTION II

Should any part of this legislation be constructed by any judicial body of this state to be unconstitutional and declared unenforceable then that part shall be severed with the rest of the act remaining in full force and effect.

SECTION III

This legislation shall be brought into law, given that it follows the procedures to do so, as outlined by the Constitution.
