An Amendment to Limit BOR.V

AN AMENDMENT
TO THE BILL OF RIGHTS
OF THE STATE OF FIRESTONE


BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS HERE ASSEMBLED THAT

AN AMENDMENT TO LIMIT BOR.V


SECTION 1: The Firestone Bill of Rights, specifically BOR.V, shall be amended.

SECTION 2: BOR.V currently states: "All individuals shall have the right to remain silent. No individual may be charged or prosecuted for retaining silence. No individual shall be forced or held to commit any act without the due process of law. No individual shall ever be forced or held to answer or speak to authorities, whether it be to prevent self-incrimination or for other reasoning. “Self-incrimination” refers to: “acts or declarations either as testimony at trial or prior to trial by which one implicates himself/herself in a crime, or having committed a crime.” All individuals have the right not to testify against themselves, and any testimony provided by an individual against themselves while being coerced by force or threats shall not be admissible as evidence for conviction of a crime.”

SECTION 3: BOR.V shall now state: " All individuals shall have the right to remain silent, whereas they cannot be compelled to deliver a testimony that will induce self-incrimination, whether it be to the court of law or law enforcement personnel. No individual shall ever be forced or held to commit any act without the due process of law. Self-incrimination shall be defined as: the exposing of oneself on testimony by making a statement that implicates that they committed a criminal offense or perpetrated something. All individuals shall have the right to not self-incriminate. Criminal defendants in the court of law can refuse to testify. Any testimony that is against one’s will, whereas one was coerced by force or threats to testify against themselves, shall not be admissible as evidence in the court of law.

SECTION 4: Upon passage within both the House of Representatives and the Senate, this amendment shall take immediate effect and be embedded into the Bill of Rights of the State of Firestone.
