An Amendment to Decriminalize Driving (R)


         Be it enacted by the Senate and House of Representatives of the State of Firestone in Congress assembled,


SECTION 1 - SEVERABILITY & ENACTMENT

(a) Should any part of this act be struck down and/or declared unenforceable, then that part shall be severed with the rest remaining in full force and effect unless all is struck down and/or declared unenforceable.

(b) Upon the completion of the constitutionally required processes, this Act shall enter into effect immediately.

SECTION 2 - CRIMINAL CODE AMENDMENT

(a) Chapter 4, section 3, subsection a1 of the Firestone Criminal Code currently states: “(a1) Hit and run shall be the act of operating a vehicle, injuring any person, other vehicle operator, damaging property, or damaging a fixed object, and then failing to stop and give assistance or failing to notify law enforcement that such incident has occurred. If a subject commits this offense, when there are no other persons present that would reasonably be involved in the incident, the subject may leave the scene of the incident, so long as they notify online law enforcement and notify the owner of the property damaged, if applicable. Subjects may also temporarily leave the scene to seek emergency assistance, however the 911 system shall be utilized first.”

(a1) Chapter 4, section 3, subsection a1 of the Firestone Criminal Code shall be amended to state: “Hit and run shall be the act of, while operating a vehicle, injuring any person, striking another vehicle (occupied or not), striking a pedestrian, damaging property, or damaging a fixed object; and failing to stop and give assistance or failing to notify law enforcement that such incident has occurred. If a subject commits this offense when there are no other persons present that would reasonably be involved in the incident, the subject may leave the scene of the incident, so long as they notify online law enforcement and notify the owner of the property damaged, if applicable. Subjects may also temporarily leave the scene to seek emergency assistance, however the 911 system shall be utilized first.”
