A Bill to Regulate Resignations

THE STATE OF FIRESTONE LEGISLATURE DOES HEREBY ESTABLISH AND ORDAIN THAT:

Section 1: It is the sense of the legislature that the current precedent established by the Supreme Court in Ronald_Reagan v. State of Firestone, 3 F.S.C. 1, and Judicial Review of a Resignation, 3 F.S.C. 11, should be voided.

Section 2: This act shall be regarded as “A Bill to Regulate Resignations” and shall take effect immediately upon becoming law.

Section 3: Severability

  (a) Should any portion of this act be declared unconstitutional by a judicial body the remainder of 
  the act shall be severed from the part so declared unconstitutional and thus the part not declared 
  not unconstitutional shall remain in full force and effect.

Section 4: Should a person wish to “resign” or issue a “resignation” in accordance with Article III § XI, Article II § V, or Article I §§ II-XII they shall do so by:

 (a) Issuing a written instrument declaring their forfeiture of a certain office, title, position, or other 
 thing on a certain time and date;

 (b) and submitting the written instrument so created under this act to a person so authorized to 
 take such a declaration.

Section 5: A written instrument issued under § 4 of this act may be retracted if the date and time listed in the written instrument has not expired at the time of the retraction. Otherwise, if date and time has expired then the written instrument shall be regarded as final and unalterable.

Section 6: Should any written instrument issued under § 4 not list a date and time then the written instrument shall be regarded as instantaneous in its nature and effect.

Section 7: Authorized Persons

(a) For the purposes of this act the following shall be permitted to take a declaration, pursuant to § 
4 of this act, for matters relevant to their position:
  1. Chief Court Justice;
  2. Governor;
  3. Lieutenant Governor;
  4. Speaker of the House;
  5. President Pro Tempore;
  6. Speaker Pro Tempore;
  7. County Executive;
  8. All persons designated as members of the “Cabinet”;
  9. And all persons designated as members of the “Sub-Cabinet”.
(b) All persons designated under § 7(a) of this act to take declarations issued under § 4 of this act 
shall be permitted to delegate such tasks to others.

Section 8: A retraction undertaken in pursuant to § 5 of this act shall be carried by the person so retracting:

(a) Issuing a written instrument declaring the written instrument issued under § 4 of this act to be 
void;

(b) and submitting the declaration issued under this section to a person so authorized to take such 
a declaration.

Section 9: This act shall not be retroactive in effect or scope.
