A Bill to Make Reckless Operation of a Motor Vehicle Illegal

BE IT ORDAINED BY THE REDWOOD CITY COUNCIL HERE ASSEMBLED THAT:

SECTION 1: Reckless operation of a motor vehicle shall be declared illegal and a violation of city ordinance.

SECTION 2: “Reckless operation of a motor vehicle” shall be defined as operating a motor vehicle in such a manner that endangers other people or property. The following actions shall construe reckless operation of a motor vehicle:

SECTION 2A: Speeding twenty (20) or more studs per second over the posted speed limit

SECTION 2B: Performing drifts, drift burnouts, or rapid turns in a motor vehicle as to quickly change direction when in close proximity to another vehicle or a pedestrian

SECTION 2C: Maneuvering quickly through multiple lanes of traffic with absence of reasonable turn signals and execution of movement, or weaving in and out of traffic

SECTION 2D: Driving a motor vehicle on the opposite side of the road toward oncoming traffic consisting of at least one (1) motor vehicle

SECTION 3: Reckless operation of a motor vehicle shall be enforced by both citation and arrest, depending upon the circumstances of this subsection:

SECTION 3A: A violator of section 2A is be guilty of a Class C Petty Offense and shall be subject to a fine of one hundred-twenty (120) dollars

SECTION 3B: A violator of section 2B is be guilty of a Class B Petty Offense and shall be subject to a fine of one hundred-fifty ($150) dollars

SECTION 3C: A violator of section 2C is be guilty of a Class B Petty Offense and shall be subject to a fine of one hundred-fifty ($150) dollars

SECTION 3D: A violator of section 2D is be guilty of a Class B Petty Offense and shall be subject to a fine of one hundred-thirty ($130) dollars

SECTION 4: A violator of two or more subsections of Section 2 shall have the vehicle impounded at the expense of the driver

SECTION 4A: A violator of three or more subsections of Section 2 shall be imprisoned for a period of not less than one hundred (100) but not exceeding three hundred (300) seconds and shall be guilty of a Class A Petty Offense

SECTION 5: The Stapleton County Sheriff’s Office, Firestone State Patrol, Firestone Department of Homeland Security, Firestone Department of Corrections, or any other law enforcement agency recognized by the State of Firestone are permitted to enforce this legislation

SECTION 6: The Stapleton County Sheriff’s Office, Firestone State Patrol, Firestone Department of Homeland Security, Firestone Department of Corrections, and Firestone National Guard shall be exempt from this legislation in the official performance of their duties.

SECTION 7: Upon passage, this bill shall go into effect immediately.

SECTION 8: All Redwood ordinances in conflict with this legislation are hereby declared null and void.
