A Bill to Establish 'Entrapment' and Provide Protection to those Entrapped (R)

A BILL TO ESTABLISH ‘ENTRAPMENT’ AND PROVIDE PROTECTION TO THOSE ENTRAPPED

BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS HERE ASSEMBLED THAT:


SECTION 1: The act of ‘Entrapment’ shall be recognized as a crime within the State of Firestone.

SECTION 2A: ‘Entrapment’ shall be defined as: The act involving an official law enforcement officer or agent of the state to induce or attempt to induce an individual to commit an unlawful action. Whereas, an unlawful action would be the violation of official law that is effective, essentially committing a crime.

SECTION 2B: Those victimized by the act of ‘Entrapment’ can have such arrests and/or citations, if committed due to them to entrapped, be expunged within the court of law. This must be proved with evidence that achieves ‘greater weight’, determined by the preponderance of the evidence presented.

SECTION 2C: Those victimized by the act of ‘Entrapment’ can use such as ‘affirmative defense’ within the court of law if they are official indicted for charges committed due to the ‘Entrapment’. Whereas, the defense must prove beyond a reasonable doubt that the defendant has been victimized to the act of ‘Entrapment’, in which that they had no actual intention to commit such unlawful actions, rather affected by the ‘Entrapment’.

SECTION 2D: An ‘law enforcement officer’, under this legislation, shall be defined as: Any individual officially employed under an law enforcement agency, this includes the Firestone State Patrol, Stapleton County Sheriff’s Office, and Firestone Department of Corrections.

SECTION 2E: An ‘agent of the state’, under this legislation, shall be defined as: Any individual officially employed within the Firestone Department of Homeland Security, Firestone National Guard, and Firestone Department of Defense.

SECTION 3: ‘Entrapment’, on the official Firestone Criminal Code, would go under chapter 2 of the code, be recognized as a ‘Class B Felony’, the card being named ‘Entrapment’, and be denoted as ‘§13’ within that chapter. The definition of this act shall be added within the description of the card. Those who are convicted of such offense shall be receive a sentence ranging from 5 hours to 15 hours at maximum.

SECTION 4: This legislation shall be enforced by the Firestone Department of Justice through prosecution and the Firestone Courts who uphold such legislation.

SECTION 5: Upon passage within both legislative chambers and met with the signature of the incumbent Firestone Governor, this legislation shall take immediate effect.
