A Bill to Define Consensual Encounters and Detainments
BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS HERE ASSEMBLED THAT:
Section 1: This legislation shall officially define the terms consensual encounter, reasonable suspicion, probable cause, and detainment.
Section 2: This legislation shall define and mandate the use of the terms consensual encounter and detainment for all law enforcement personnel within the State of Firestone; the Firestone State Patrol, Stapleton County Sheriff’s Office, Department of Corrections, and Department of Homeland Security shall use the terms as stated.
Section 2A: A Consensual Encounter shall be defined as: [The encounter between a law enforcement officer and a pedestrian where the law enforcement officer has no reasonable suspicion (to believe an individual is about to commit, has committed, or is committing a crime), or probable cause (to believe that an individual has committed a crime because you know and saw them commit one), to perform a stop. The pedestrian will be free to refuse to answer any questions asked and have the option of leaving]. If a law enforcement officer refuses to let a pedestrian go when he/she wishes to leave during a consensual encounter, then that law enforcement officer shall be charged with unlawful detainment.
Section 2B: Any pedestrian who falls victim to an unlawful detainment by any law enforcement officer will have the full right and discretion to prosecute that said law enforcement officer in the court of law. The Firestone Courts shall oversee all cases related to unlawful detainment. The Department of Justice shall have the role of prosecuting/investigating any law enforcement officer accused/charged with unlawful detainment. Any individual who wishes to prosecute a law enforcement officer for unlawful detainment will need to file for a civil litigation. An unlawful detainment shall be considered a misdemeanor.
Section 2C: A Detainment shall be defined as: [The detention of an individual who is not permitted to leave when stopped by a law enforcement officer until given permission to do so]. A detainment shall require reasonable suspicion. If a law enforcement officer does not have reasonable suspicion when conducting a detainment on an individual, then that individual shall be free to leave at his or her’s own discretion.
Section 2D: Reasonable Suspicion shall be defined as believing that an individual is going to commit, has committed, or is committing a crime. As stated within Section 2A if this legislation, all detainments shall require reasonable suspicion.
Section 2E: Probable Cause shall be defined as an officer knowing that an individual has committed a crime since that he or she saw it be committed or by having received sufficient evidence of the crime an individual committed. All arrests and citations conducted by law enforcement officers shall require probable cause.
Section 3: It shall be the duties of the Firestone State Patrol, Stapleton County Sheriff’s Office, Department of Corrections, Firestone Courts (Court Justice+), Department of Justice, and Department of Homeland Security to enforce this legislation. It shall also be duties of the Firestone Peace Officer Standards and Training to train and teach the terms stated within this legislation to all POST cadets pursuing a career in law enforcement.

Section 3F: The Firestone Courts shall be defined as: Firestone Courts - Roblox

Section 4: This legislation shall go into effect immediately upon passing.
Section 5: All laws in conflict with this legislation are hereby declared null and void.
