Public Safety Unification Act V2

BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS HERE ASSEMBLED THAT:

PREAMBLE: To organize all department regulations and operations into one unified document.

SECTION 1: The Public Safety Unification Act shall be declared null and void.

SECTION 2: The Firestone Department of Public Safety shall be considered a department in charge of overseeing several prominent and notable local police, fire, medical departments and academies within the State of Firestone.

SECTION 2A: The Firestone Department of Public Safety may suspend any employee of any department the Firestone Department of Public Safety has jurisdiction over; as long as they are not the department head of the department in question and a message to the department head has been sent concerning the suspension. Suspensions issued by the Firestone Department of Public Safety may not exceed 20 days unless a message of direct consent for suspension extension is received from the department head in question.

SECTION 2B: The Firestone Department of Public Safety may fire any employee of any department the Firestone Department of Public Safety has jurisdiction over; as long as they are not the department head of the department in question, and a message to the department head has been sent concerning the termination.

SECTION 2C: The Firestone Department of Public Safety may issue Public Safety Directives which must be followed by all departments that the Department of Public Safety has jurisdiction over. Should a department head instruct their department not to follow a Public Safety Directive, they shall be subject to impeachment. The Firestone Congress may veto/nullify any Public Safety Directive with a supermajority vote from both congressional chambers.

SECTION 2D: The Firestone Department of Public Safety may use evidence from any official Firestone Discord(s), or any other third party communication service that may contain an official chat. Deleting, hiding, or removing evidence in any way which is under investigation by the Department of Public Safety warrants an immediate suspension or termination for the person who committed the aforementioned act, this shall be known as tampering with evidence.

SECTION 2E: The Firestone Department of Public Safety shall have the power to blacklist anyone they should choose from employment within any department that the Firestone Department of Public Safety has jurisdiction over with a plausible and acceptable reason. The Department of Public Safety may also revoke POST Certifications if deemed necessary following an investigation. This shall be referred to as a Public Safety Blacklist. All department heads under the jurisdiction of the Department of Public Safety must have a way of viewing all individuals under the Public Safety Blacklist, as provided by the Department of Public Safety. Should an individual be issued a Public Safety Blacklist, any certifications they hold in the state shall be revoked (POST, SCFD, etc). Shall a department head knowingly accept someone into their department who has been issued a Public Safety Blacklist, the department head in question shall be subject to impeachment.

SECTION 2F: If an individual holds an active Public Safety Blacklist, and later becomes a member of a department under the jurisdiction of the Firestone Department of Public Safety, the department head of the department in question is to be notified by the Firestone Department of Public Safety, and be given 48 hours from the time of the notification being sent to remove the individual on the Public Safety Blacklist from their department.

SECTION 2G: Should an individual become blacklisted at the same time the individual in question is apart of a department under the jurisdiction of the Firestone Department of Public Safety, then the individual shall be immediately terminated from the department.

SECTION 2H: The Firestone Department of Public Safety shall have the power to blacklist anyone they should choose from ride-alongs with any department that the Firestone Department of Public Safety has jurisdiction over, with a plausible and acceptable reason. This shall be referred to as the Public Safety Ride-Along Blacklist. All department heads under the jurisdiction of the Department of Public Safety must have a way of viewing all individuals under the Public Safety Ride-Along Blacklist, as provided by the Department of Public Safety.

SECTION 2I: The Firestone Department of Public Safety shall have the power to investigate and perform audits on any department under the jurisdiction of the Department of Public Safety. This shall be referred to as a Public Safety Audit. Within a Public Safety Audit, the Department of Public Safety is authorized to observe and audit the policies, staff, training, and any other branches necessary to result in an effective conclusion on the overall wellness of a department. The Department of Public Safety may send suggestions about how to better perfect and improve a department to the department head in question. All departments must be directly informed that they are under audit; secretive audits and investigations are forbidden.

SECTION 3: Before terminating an employee of any department affiliated with the Department of Public Safety, the Secretary of Public Safety is required to attempt to speak to the department head beforehand to see if they have any objections with the termination. Before a POST certification is revoked by the Department of Public Safety, the Secretary of Public Safety is required to attempt to speak to the POST Director regarding it beforehand to also see if they have any objections with the revocation.

SECTION 4: The Firestone Department of Public Safety shall have jurisdiction over the Firestone State Patrol, Stapleton County Sheriff’s Office, Stapleton County Fire Department, Department of Corrections, Department of Transportation, Department of Public Works, Peace Officer Standards and Training, and any other official state-level or county-level academies that may be established at a later date.

SECTION 4A: The Governor may add or remove any other Firestone department not included in Section 2 to the jurisdiction of the Department of Public Safety with a plausible and acceptable reason; although at the end of the term in which a department may have been added, its holding will become void. (i.e. if Governor A added Department X to the jurisdiction of the Department of Public Safety and the gubernatorial term ends on April 1st, then upon reaching April 1st Department X shall no longer be under the jurisdiction of the Department of Public Safety).

SECTION 4B: Should the Governor add any other Firestone department not included in Section 2 to the jurisdiction of the Department of Public Safety through Section 2A; and the Department of Public Safety and the newly added department in question both believe the department in question should not be under the holding of the Department of Public Safety, the Governor shall be expected to respond and resolve the issue in an appropriate manner.

SECTION 5: The Secretary of Public Safety and the Governor shall have the power to give or restrict the powers listed in the entirety of Section 1 to any member of the Department of Public Safety and any member of departments under the Department of Public Safety.

SECTION 5A: In the case that there is no Secretary of Public Safety, the Deputy Secretary of Public Safety shall serve as the Acting Secretary of Public Safety and may give or restrict the powers listed in the entirety of Section 1 to any member of the Department of Public Safety. If there is no Deputy Secretary of Public Safety, the Governor may choose an Acting Secretary of Public Safety until the Secretary has been confirmed by the Firestone Senate.

SECTION 5B: The Governor of Firestone has the ability to overrule and thus nullify any ruling, decision, directive, policy, etc. made by the Department of Public Safety should the need and desire arise to do so. The Governor of Firestone has the ability to set policies and regulation that the Department of Public Safety must follow should the need and desire arise to do so.

SECTION 5C: Should a concern arise with a department head about a ruling or decision of the Department of Public Safety, the Secretary of Public Safety shall be required to respect the concern of the department head and resolve the concern in question. If a notable disagreement arises between a department head under the jurisdiction of the Department of Public Safety and the Secretary of Public Safety, the Governor shall be expected to resolve the disagreement in an appropriate and efficient manner.

SECTION 6: The Governor of Firestone shall oversee this legislation. The Firestone Department of Public Safety, Firestone State Patrol, Stapleton County Sheriff’s Office, Stapleton County Fire Department, Department of Transportation, Department of Public Works, Department of Corrections, and the Peace Officer Standards and Training shall enforce this legislation. Any departments that find themselves under the jurisdiction of the Department of Public Safety in the future shall also enforce this legislation.

SECTION 6A: A Public Safety Directive shall be defined as an official or authoritatively written instruction issued by the Department of Public Safety.

SECTION 6B: Ride-alongs shall be defined as any sort of arrangement for a civilian, not apart of the department in question, to ride in a department vehicle to observe what the department member does and to observe his/her duties on a workday.

SECTION 6C: Suspensions shall be defined as temporary prevention of an individual performing their usual duties and role for a certain amount of time.

SECTION 7: Upon passing both chambers of the Firestone Congress, alongside being signed in by the Governor, this legislation shall go into effect immediately.
